On November 7, 2025, the Act of October 17 amending the Act on the Protection of the Rights of Purchasers of Residential Premises or Single-Family Homes and the Developer Guarantee Fund (the " Developer Act ") and certain other acts (the " Amendment ") was submitted for signature by the President of the Republic of Poland. This Act introduces the rules for operating the Housing Trading Data Portal (the "DOM Portal "). In this article, we will explain what data will be collected by the Portal and when, and who will have access to it.

Pursuant to Article 56a of the Development Act, added by the Amendment, the DOM Portal is to be operated by the Insurance Guarantee Fund. It will collect and process data and information regarding the sale of residential premises and single-family homes in the territory of the Republic of Poland, as well as:

  • creating, maintaining and developing an access point to information on transaction prices of residential premises and single-family houses;
  • generating or developing statistical information based on them to support policies that support meeting the housing needs of citizens, including statistical information on participants in this trade.

The above data will be obtained from all transactions involving the transfer of legal title to real estate in Poland, i.e.:

  • real estate constituting residential premises and single-family houses from the primary market, which are subject to the obligation to maintain a housing escrow account in accordance with the provisions of the Developer Act;
  • real estate constituting residential premises from the primary market, not subject to the obligation to maintain an escrow account;
  • real estate from the primary and secondary market provided by the Head of the National Revenue Administration based on information resulting from notarial deeds reported by notaries, excluding information regarding life annuity agreements and exchange agreements.

Statistical data collected by the DOM Portal , such as the number of transactions and the average or median transaction prices for residential units and single-family homes, will be publicly available . This means that any interested party will be able to verify average transaction prices for a selected period and area, although this is subject to certain limitations.

Pursuant to Article 56e of the Development Act, these data will be made public only when, for the location, period and type selected by the DOM Portal user, the following data are met:

  • the number of residential premises or single-family houses is at least six;
  • the number of different buyers is at least six.

The above restrictions are intended to maintain the anonymity of transactions and property buyers. These changes, introduced following the adoption of the Price Transparency Act , are a continuation of legislators' efforts to increase the transparency of the Polish real estate market.

The Act has been submitted to the President of the Republic of Poland for signature, but as of the date of this article, it has not yet been signed . Consequently, the legislative process remains ongoing, and the proposed regulations currently have no legal effect.

It should be emphasized that at this stage, it is possible that the bill will not ultimately come into force. The President could exercise his constitutional authority to refuse to sign it, referring the bill back to the Sejm. Exercising this authority would mean a delay in the bill's entry into force or its non-enactment. However, this seems unlikely, as there is political consensus on this matter.

The DOM portal is to start operating 16 months after the date of publication of the Act.
