On November 27, 2020, the Act amending the Act on special solutions related to the prevention, counteraction and combating of COVID-19, other infectious diseases and crisis situations caused by them and certain other acts was adopted.
The Act introduces the possibility of remote work for employees under home isolation who do not show symptoms of COVID-19 or whose symptoms are mild.
It is important to remember that isolation applies to individuals who have tested positive for SARS-CoV-2. As a general rule, employees undergoing isolation are treated as unfit for work and are therefore entitled to sick pay or sickness benefits.
The Act stipulates that remote work is possible with the employer's consent. Therefore, the employee should initiate remote work and obtain the employer's consent. If consent is granted, the employee will be entitled to work remotely and receive remuneration for their work.
The amendment also takes into account that in the event of a deterioration in the health of an employee staying in home isolation, he or she will be entitled to sick pay or cash benefits for the period of isolation during which he or she did not work remotely.
The bill is waiting for the President's signature.
