On May 8, 2025, the Sejm adopted an amendment to a parliamentary bill amending the Labor Code. Under the new regulations, employers will be required to disclose information about a candidate's salary at one stage of the recruitment process.
The original version of the project
Work is currently underway on the final version of the bill. The initial draft required the publication of salary ranges in job advertisements. The draft also stipulated that employees would have the right to obtain information about their own remuneration and the average earnings within a given group of employees (by gender) performing the same or equivalent work.
What has changed?
Under the new regulations, employers will still be required to provide candidates with salary information, but will have greater flexibility regarding when this information is disclosed. This information can be provided:
- in the job advertisement,
- before the interview (if not provided earlier),
- before signing the contract (if not provided at any earlier stage).
Additionally, the new regulations impose an obligation on employers to ensure that job advertisements are gender-neutral and that the entire recruitment process is non-discriminatory.
What remains unchanged?
The amendment does not require the publication of salary information in job advertisements. Employers have the freedom to choose the stage at which they inform candidates of their proposed salary. In practice, this means that the changes will not significantly impact current recruitment procedures.
The proposed solutions are in line with the EU Directive 2023/970 on pay transparency, which gives Member States wide scope to adapt the regulations to national realities.
Summary
Although the adopted changes aim to increase transparency in employer-employee relations, they do not constitute a revolution in the labor market. In practice, employers retain considerable discretion in disclosing salaries during the recruitment process.
