In 2025, the National Labour Inspectorate (PIP) has planned to carry out a record 55,000 inspections of entrepreneurs.

According to information provided by Chief Labor Inspector Marcin Stanecki, next year the labor inspectorate will focus on verifying the legality of employment and work performed by Polish citizens and foreigners. Inspections will include detecting both undeclared work, i.e., work performed entirely "illegally," and work reported incorrectly. This includes situations where actual working hours or remuneration are higher than indicated in the employment contract.

The focus will be on, among other things, the legality of employment, respect for the rights of temporary workers, the application of work-life balance regulations, and other key issues related to occupational safety and the protection of workers' rights.

PIP inspectors will be particularly vigilant in monitoring the activities of temporary work agencies, employment agencies, and the companies that use their services. Inspections will focus on:

  • Abuse of civil law contracts – verification of cases in which contracts of mandate, contracts for specific work or B2B contracts are used instead of employment contracts.
  • Circumventing the provisions of the Temporary Employment Act – inspectors will check outsourcing practices used in a manner inconsistent with the law, i.e. where temporary employment actually occurs.
  • Working conditions of temporary workers – verification whether employees are provided with remuneration and conditions in accordance with the regulations.

The inspections are aimed at verifying compliance of employment conditions with labor law provisions and eliminating abuses in the use of civil law contracts.

2025 promises to be a period of increased scrutiny by the National Labor Inspectorate, requiring employers to exercise particular caution in the use of civil law contracts. Reclassifying contracts as employment contracts can lead to significant financial and legal consequences. Therefore, it's worth reviewing existing contracts now and making the necessary changes to minimize future risks.

Employers should prepare for these inspections by:

  • review of existing civil law contracts,
  • analysis of the conditions for their implementation,
  • introducing appropriate procedures and internal documentation.
