As early as September 25, the Law on the Protection of Whistleblowers - on which work has been ongoing since 2021 - enters into force. The fact that the obligations that the Act imposes on Entrepreneurs will affect a not inconsiderable group of them (the minimum threshold at 50 people employed under employment contracts and other forms of employment), as well as the short period between the completion of work on the Act and its entry into force - has caused considerable information chaos.

At this point, it is worth mentioning that failure to implement internal procedures for the protection of whistleblowers, as well as the improper implementation of such procedures, may result in a number of different types of sanctions, as specified in the Law.
And yes - failure to implement the internal reporting procedure can result in a fine for the obligated party. Retaliation against a whistleblower is punishable by a fine, restriction of liberty or imprisonment for up to 2 years (in the case of persistent retaliation - up to 3 years). Preventing or obstructing a potential whistleblower from reporting, in turn, is punishable by a fine, restriction of liberty or imprisonment for up to 1 year, and if the prevention, obstruction is accompanied by violence, threats or other deception - the perpetrator faces imprisonment for up to 3 years.
The Act, which comes into force already on September 25, therefore represents a momentous change in the day-to-day functioning of Enterprises. Therefore, preparing for the implementation of the Act's obligations, it is worth thoroughly familiarizing oneself with its content - which is served by the SYGNALISCI-INFO information campaign!
