Effective May 1, 2025, a number of significant changes to labor law and the benefits system were introduced, aimed at improving working and employment conditions in Poland. Among the most important changes were regulations regarding the employment of foreigners and new benefits paid by the Social Insurance Institution (ZUS).

New benefits paid by ZUS

As of May 1, 2025, the Social Insurance Institution (ZUS) began paying supplements to individuals completely unable to work and function independently. This benefit will be provided in conjunction with the social pension. Eligible individuals will receive a monthly supplement for January and February 2025, totaling PLN 2,520 gross. Following the March indexation, the benefit amount increased to PLN 2,610.72 gross.

New regulations regarding the employment of foreigners

In turn, the new Act on the Employment of Foreigners, which came into force on May 1st, changes the rules for employing foreigners in Poland. The new regulations require employers to electronically report all formalities related to the employment of foreigners. Furthermore, employment contracts must be concluded in writing, and copies must be submitted to the relevant authorities before the foreigner begins work.

Another significant change is that the remuneration offered to foreigners cannot be lower than the minimum wage specified in the regulations. The National Labor Inspectorate and the Border Guard have also been granted increased powers, allowing them to conduct unannounced inspections of employers. Violations of the regulations will result in hefty fines ranging from PLN 3,000 to as much as PLN 50,000, depending on the number of foreigners employed illegally. Before the change, the fine ranged from PLN 1,000 to PLN 30,000.

The amendment to the Act implements the assumptions contained in the National Recovery Plan, which aims to simplify procedures and ensure better protection of the labor market.

Pilot short-time work program

The Ministry of Labor and Social Policy has announced the launch of preparations for a pilot short-time work program. This program aims to improve work quality and test new solutions in various economic sectors. Businesses, local governments, foundations, associations, and trade unions will be eligible to participate.

The program's rules and details will be announced by the end of June 2025, and recruitment will begin thereafter. Additionally, a team will be established to monitor and support the program's implementation, which will also work on legislative recommendations regarding short-time work.

The Ministry announces that further changes to labor law regulations will take place in the coming months, and details of the new solutions will be regularly published.
