On September 8, 2020, a regulation of the Minister of Climate entered into force, amending the regulation of November 27, 2019, on the list of liquid fuels whose use requires a license and entry in the register of importers. This regulation introduces changes to certain CN codes listed in the regulation on the list of liquid fuels.

Also in § 1 point 2 regarding LPG, an exclusion was introduced for CN code 2901 10 00 for products intended for purposes other than heating, propulsion or navigation. 

Taking the above into account, it should be remembered that in accordance with Article 32, paragraphs 2a and 2c of the Act of 10 April 1997 – Energy Law, entities that perform activities consisting in:

  • manufacturing,
  • storage,
  • reloading,
  • sending,
  • distribution,
  • turnover (including foreign trade),
  • or import of liquid fuels,

are obliged to submit an application for granting or amending a license or to submit an application for entry or amendment of an entry in the register of importing entities.

Please remember to pay the stamp duty on these applications. The deadline for completing these steps is 30 days from the date these regulations come into force, i.e., by October 8, 2020, to the President of the Energy Regulatory Office.
