Pursuant to the Act, the National Labour Inspectorate (PIP) is the body appointed to supervise and control compliance with labour law, in particular the provisions and principles of occupational health and safety, as well as provisions regarding the legality of employment and other gainful work, within the scope specified in the Act.

Who can submit a request for an employer inspection?

Every employee has the right to notify the National Labor Inspectorate of violations of labor law, including occupational health and safety regulations, legality of employment, employment relationship, remuneration and other benefits resulting from the employment relationship, working time, leave, parental rights, employment of minors and disabled persons.

What should a complaint contain?

A complaint submitted to the National Labor Inspectorate should contain the following elements:

  1. name and address of the complainant;
  2. the subject and address of the entity concerned by the complaint.
  3. Handwritten signature (if submitted in paper form) or a qualified electronic signature, trusted signature or personal signature, if submitted by electronic means of communication,
  4. the address of the electronic means of communication of the applicant (if it is not clearly stated in the complaint).

It should be emphasized that anonymous complaints are not considered by PIP.

Where to file a complaint?

The employee should submit a complaint to the District Labour Inspectorate or the branch of the District Labour Inspectorate competent for the employer's registered office.

Deadline for inspection

Complaints are reviewed without undue delay, but no later than one month from their receipt by the National Labor Inspectorate. After the complaint is reviewed and an inspection is conducted at the employer's premises, the complainant is informed of the outcome of the investigation. It is worth noting that the National Labor Inspectorate is not obligated to inform the complainant of the inspection date or its detailed results.

Anonymity of the complaint

Many employees fear that their employer will learn of a complaint. The data of the person filing a complaint with the National Labor Inspectorate (PIP) is protected and not disclosed during an inspection. However, in certain situations where it is necessary to provide employee data, the PIP will request consent to disclose it to the employer.
