As a result of the efforts of the litigation department of the Kijewski, Graś sp.k. law firm, the District Court in Warsaw dismissed a claim for payment of over PLN 9 million brought against a well-known developer for allegedly unpaid remuneration.

The first-instance court almost entirely agreed with the arguments presented by the firm's lawyers. It found, among other things, that the Plaintiff lacked standing to bring the action because the Plaintiff did not acquire the receivables based on the assignment, given the grossly inequitable price and grossly unfavorable contractual terms. The court also agreed with the Defendant's arguments regarding the erroneous understanding of the provisions of the sales agreement.

The appropriate line of defense of the developer's rights adopted by the firm's lawyers ultimately led to the complete dismissal of the Plaintiff's claims and thus to a huge success.
