e-Delivery will be the main tool for communication between entities entered in the National Court Register and public administration bodies from December 10, 2023. In this article, we will discuss what exactly e-Delivery will be used for, who will be required to have an electronic address, and how to obtain such an address.

e-Delivery – what are they and who is obliged to have an electronic address?

Pursuant to the Electronic Delivery Act, public administration bodies will deliver correspondence requiring confirmation of dispatch or receipt using the public registered electronic delivery service to an electronic address entered in the electronic address database, which every commercial company and other required entities will have. The introduction of e-Delivery aims to streamline administrative processes and minimize correspondence costs. Traditional correspondence will be replaced by electronic means, facilitating and expediting proceedings.

The introduced e-Delivery services are aimed at unambiguous identification of the sender and the addressee, maintaining the confidentiality of correspondence, ensuring the integrity of the transmitted data, ensuring access to reliable and legally accepted evidence of dispatch and receipt, access to information on the date and time of sending and receiving correspondence, and are aimed at quickly determining the address for e-Delivery of the recipient.1

Effect of e-Delivery

Letters delivered to electronic addresses by public administration bodies will have the same legal effect as letters delivered traditionally, by registered mail.

Who is required to set up an e-mail address?

Pursuant to Article 9 of the Act on Electronic Delivery, from December 10, 2023 , the following persons are obliged to have an electronic delivery address entered in the database of electronic addresses, associated with the public registered electronic delivery service:

  • persons practicing a freelance profession, i.e. an attorney, legal counsel, tax advisor, restructuring advisor, patent attorney, notary;
  • a non-public entity entered into the register of entrepreneurs maintained by the National Court Register, i.e. commercial law companies .

Companies entered in the register of entrepreneurs after December 10, 2023

As of December 10, 2023, every newly entered entity in the register of entrepreneurs maintained by the National Court Register will automatically receive an electronic delivery address linked to the public registry service. This means that commercial law companies will no longer be required to submit applications for such an address after this date.

Sole proprietorships and e-Delivery

Sole proprietorships will only be required to have an electronic delivery address from 1 October 2026. However, this does not prevent sole proprietorships from establishing an electronic delivery address before that date and communicating with public administration bodies, which may prove to be a convenient way to communicate with offices.

The above is not a closed list, which means that any entity not listed above may have an address for electronic delivery for the purpose of contacting public administration bodies.

Sole proprietorships entered into CEIDG after 1 January 2024.

Also, the situation in the case of sole proprietorships entered into CEIDG after 1 January 2024 is the same as for commercial law companies that will be entered after 10 December 2023. The address for electronic delivery for sole proprietorships will be created automatically.

How do I get an e-mail address for e-Delivery?

In order for a commercial company or a person practicing the profession mentioned above to be assigned an address for electronic delivery, it is obliged to submit an appropriate application, which is completed and submitted online at – link .
