The Whistleblower Protection Act, on which work has been ongoing since 2021, comes into force on September 25. The fact that the obligations imposed by the Act on Entrepreneurs will apply to a large group of them (the minimum threshold is 50 people employed under an employment contract and other forms of employment), as well as the short period from the completion of work on the Act to its entry into force, has caused considerable information chaos.

In response to this situation, Graś i Wspólnicy Law Firm has decided to launch the SYGNALISCI-INFO information campaign, aimed at Polish entrepreneurs. It is worth mentioning here that failure to implement internal procedures for whistleblower protection, as well as their improper implementation, may result in a number of different types of sanctions, specified in the Act.

Failure to implement the internal reporting procedure may result in a fine being imposed on the person responsible. Retaliatory actions against a whistleblower may result in a fine, restriction of liberty, or imprisonment for up to two years (or up to three years if the retaliatory actions are persistent). Preventing or hindering a potential whistleblower from reporting may result in a fine, restriction of liberty, or imprisonment for up to one year. If the prevention or obstruction is accompanied by violence, threats, or other deception, the perpetrator may face imprisonment for up to three years.

The Act, which comes into force on September 25th, therefore represents a significant change in the daily operations of businesses.
